Terms and Conditions for WordPress Website Development Services

These Terms and Conditions govern the provision of WordPress website development services by JustScroll Website Service (“we,” “us,” or “our”). By engaging our services, you (“Client”) agree to comply with and be bound by these terms.

1. Scope of Services

1.1 Website Development: JustScroll offers WordPress website development services, which may include design, development, and customization based on the Client’s requirements.

1.2 Additional Services: Any services outside the agreed scope, such as additional plugins, features, or content creation, will be charged separately. These services require a written agreement.

2. Client Responsibilities

2.1 Project Requirements: The Client agrees to provide all necessary information, materials, and feedback in a timely manner to facilitate the project. Delays in providing required materials may impact the project timeline.

2.2 Content Ownership: The Client warrants that they own or have the right to use any content provided for use in the website, including images, text, videos, and trademarks. The Client is solely responsible for ensuring that no content infringes on third-party rights.

2.3 Review and Approval: The Client is responsible for reviewing and approving deliverables within the specified timeframes. If no feedback is provided within the agreed period, the deliverable will be considered accepted.

3. Payment Terms

3.1 Fees: The total project fee will be outlined in the project proposal or invoice. Payments are to be made according to the agreed schedule, typically with an initial deposit and final payment upon project completion.

3.2 Late Payments: Invoices are due within 30 days of issuance. Late payments may incur interest at a rate of 5% per month or the highest rate permitted by law.

3.3 Cancellation: If the Client cancels the project after work has begun, the Client will be responsible for all work completed up to the cancellation date, plus any additional costs incurred.

4. Revisions and Changes

4.1 Revisions: The project includes 3-5 rounds of revisions. Additional revisions may be subject to additional fees.

4.2 Scope Changes: Any changes to the agreed-upon scope of work will require a written change order and may incur additional costs.

5. Intellectual Property Rights

5.1 Ownership: Upon full payment, the Client will own the final website design and content. However, JustScroll retains the rights to any custom code or templates developed unless otherwise agreed.

5.2 Licenses: The Client will be responsible for any third-party licenses required for plugins, themes, or other assets used in the website.

5.3 Portfolio Use: JustScroll retains the right to display the completed project in our portfolio and promotional materials unless otherwise requested by the Client in writing.

6. Warranty and Liability

6.1 Warranty: JustScroll provides a 30 day warranty period for bug fixes and technical support post-launch. This warranty does not cover issues arising from modifications made by the Client or third parties.

6.2 Limitations of Liability: To the fullest extent permitted by law, JustScroll shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the website, even if advised of the possibility of such damages.

7. Confidentiality

Both parties agree to keep any confidential information received during the project strictly confidential. Confidential information includes, but is not limited to, business strategies, technical data, and proprietary information.

8. Termination

8.1 Termination by Client: The Client may terminate the project at any time, subject to payment of fees for work completed up to the date of termination.

8.2 Termination by JustScroll: JustScroll reserves the right to terminate the project if the Client breaches these terms or engages in activities that harm our reputation or operations.

9. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these terms shall be resolved in the courts of Malaysia.

10. Changes to Terms and Conditions

JustScroll may update these Terms and Conditions periodically. Any changes will be posted on this page, and your continued use of our services constitutes acceptance of the revised terms.
